Welcome to the website of Tess Jewell-Larsen. These Terms of Use explain the conditions that apply when you visit my website, purchase a service or product, or take part in my programs.
Please read them before using the website or making a purchase. If you have questions, you can contact me at [email protected].
1. About me
This website is operated by:
Name: Tess Jewell-Larsen
Trading name: Tytoni Yoga
NIF: X3175452A
Address: C/ Marqués de Casa Valdés 70, Gijón, Asturias, Spain
Email: [email protected]
Website: https://www.tessjewelllarsen.com
I provide yoga therapy, therapeutic yoga, wellness coaching, online classes, recorded courses, digital resources, memberships, group programs, workshops and in-person sessions.
These Terms are governed by applicable Spanish and European Union law, including consumer protection and data protection rules where relevant.
2. Who these terms apply to
These Terms apply to your use of this website and to purchases or participation in my services, including:
Online yoga classes and studio memberships.
Recorded courses, downloadable resources and other digital content.
One-to-one yoga therapy and wellness coaching.
Live group programs, workshops and online events.
In-person classes, sessions and other services.
Some offers may have additional terms, such as a program description, booking policy or payment plan. Where those terms apply, they should be read alongside these Terms. If there is a conflict, the specific terms for the offer will apply to that offer to the extent permitted by law.
My services are intended for adults aged 18 and over. I do not currently offer services to people under 18.
3. Using this website
You agree to use this website lawfully and respectfully.
You must not:
Use the website for fraudulent, unlawful or misleading purposes.
Attempt to disrupt, damage or gain unauthorised access to the website, its systems or another person's account.
Upload or transmit malicious software or harmful material.
Copy, reproduce, distribute or commercially exploit website content without permission.
I may restrict or suspend access where there is a reasonable basis to believe that someone has breached these Terms, misused the website or compromised the safety of other users. Any action will be subject to applicable law and any rights you may have as a consumer.
4. Services and bookings
Details of each service, including its format, price, duration, inclusions and any specific conditions, will be provided on the relevant sales or booking page.
I will take reasonable care and skill in providing the services you purchase. I may use third-party providers or platforms to help deliver services, process payments or provide access to digital content.
I reserve the right to decline a booking where there is a legitimate reason, including where a service is not appropriate for your needs or I am unable to provide it safely or within my professional scope. If I cannot fulfil a booking you have paid for, I will explain the available options, including any refund or rescheduling rights that apply.
Private sessions and packages
Please give at least 48 hours' notice if you need to cancel or reschedule a private session.
If you cancel or request a change with less than 48 hours' notice, or do not attend, the session may be charged in full or deducted from your package. This reflects the time reserved for you and the difficulty of offering that appointment to someone else at short notice.
If you cancel with at least 48 hours' notice, we can arrange another suitable appointment, subject to availability.
Private sessions and packages should be used within the expiry period stated when you purchase them. If no different period is stated, private sessions and packages expire three months after purchase.
These conditions do not remove any mandatory rights you may have under applicable consumer law.
Group classes, workshops and in-person events
Cancellation, rescheduling, make-up and attendance arrangements for group classes, workshops and in-person events will be stated on the relevant booking page or in the information provided when you book.
Where a class or event is cancelled by me, I will let you know and offer an appropriate alternative, such as rescheduling, access to a recording where suitable, or a refund where required by law or the circumstances of the booking.
Please arrive in time to participate safely and follow any reasonable instructions relating to the venue, equipment and wellbeing of the group.
5. Online studio, memberships and subscriptions
Some services are provided through a recurring monthly or annual subscription. The price, billing frequency, access arrangements and any special conditions will be shown before you purchase.
Unless the offer states otherwise, subscriptions renew automatically at the end of each billing period until cancelled.
You can cancel a subscription either:
Through your account, where the cancellation option is available; or
By emailing [email protected].
Please cancel before your next renewal date to avoid the next payment being taken. If you cancel, your access will normally continue until the end of the period you have already paid for, unless the offer states otherwise or applicable law requires a different outcome.
Cancelling stops future renewals; it does not automatically refund a payment already made. However, this does not affect any refund or withdrawal rights you have under applicable law.
If a payment fails, I may suspend access while the payment issue is resolved. I will not apply this provision in a way that overrides your legal rights.
6. Prices, payments and invoices
Prices will be displayed on the relevant offer or checkout page. Unless stated otherwise, prices are shown in euros (€). Any applicable taxes, including VAT where applicable, will be shown as required by law.
Payment must be completed using the payment methods available at checkout. Payments may be processed by a third-party payment provider. Your use of that provider may also be subject to its own terms and privacy policy.
You agree to provide accurate billing and contact information and to use a payment method you are authorised to use.
Where applicable, I will provide an invoice or other payment documentation in accordance with Spanish tax requirements.
Promotional codes and discounts may be subject to specific conditions, which will be explained when the offer is made. Unless stated otherwise, discounts cannot be applied retrospectively to purchases already completed.
7. Cancellations, refunds and your legal rights
The cancellation and refund terms for a particular offer will be explained on its sales or booking page. Any policy that says a purchase is non-refundable is subject to any mandatory consumer rights that apply.
If you are a consumer purchasing online, you may have a statutory right to withdraw from a contract within 14 days, depending on the type of service or digital content purchased and the circumstances of the purchase.
Different rules can apply to services that begin during the withdrawal period and to digital content supplied immediately. Where the law permits an exception to the withdrawal right, I will request any required express consent or acknowledgement before supplying the relevant service or content.
If you ask me to begin a service during the withdrawal period, you may be required to pay a proportionate amount for the service already supplied if you subsequently withdraw, where the law provides for this.
Nothing in these Terms is intended to remove or limit any consumer right that cannot legally be excluded.
If you have a question about cancelling or requesting a refund, please email [email protected] with your order or booking details.
8. Yoga therapy, wellness coaching and personal responsibility
My work uses therapeutic yoga, movement, breathwork, relaxation, mindfulness and related wellbeing practices to support your wellbeing. These services are educational and supportive in nature. They are not a substitute for medical diagnosis, medical treatment, psychotherapy or emergency care.
I do not diagnose medical conditions or promise a particular health outcome. Results and experiences vary from person to person.
You are responsible for deciding whether an activity feels appropriate for you and for letting me know about relevant limitations, injuries, symptoms, changes in health or other concerns that may affect your participation. Please seek advice from a suitably qualified healthcare professional when needed, particularly if you have a medical condition, are experiencing new or concerning symptoms, or are unsure whether a practice is appropriate for you.
Please work within your own comfort and ability, stop if you experience pain, dizziness, unusual shortness of breath or other concerning symptoms, and seek appropriate medical advice where necessary.
I may adapt a practice, suggest an alternative or recommend that you consult another professional if I believe this would better support your safety or needs. Where appropriate, I may recommend working alongside your healthcare team or seeking support outside my professional scope.
9. Your account and access
Some purchases require you to create an account. You are responsible for keeping your login details secure and for notifying me if you believe someone has accessed your account without permission.
Unless a product or offer expressly allows otherwise, access to courses, videos, downloads and membership materials is for your personal use only. You must not share login details or provide access to paid materials to other people.
Access may be affected by maintenance, technical problems or third-party platform outages. I will take reasonable steps to address issues within my control, but I cannot guarantee uninterrupted access at all times.
Where an access problem materially affects a service you have purchased, please contact me so that we can work towards a reasonable solution, subject to your legal rights.
10. Intellectual property and permitted use
Unless otherwise stated, the content on this website and the materials I create—including text, videos, audio recordings, course materials, worksheets, photographs, graphics, branding and practice scripts—are owned by me or used with permission and are protected by intellectual property law.
When you purchase or access materials, you receive permission to use them for your own personal, non-commercial use, in accordance with the terms of the relevant offer.
You must not, without my prior written permission:
Copy, reproduce, distribute, publish, sell or share my materials.
Upload course content or recordings to another platform.
Record, redistribute or publicly share paid classes or sessions.
Modify my materials for redistribution or create commercial products from them.
Use my name, branding or content in a way that suggests endorsement or affiliation.
Purchasing a course, class or membership does not transfer ownership of the materials to you.
If you would like to use any of my content for another purpose, please contact me to discuss permission.
11. Comments, testimonials and content you share
If you send me feedback, a testimonial, a photograph, a recording or other content, you remain responsible for having the rights and permissions needed to share it.
I will not assume that your participation in a class, group program or session gives me permission to use your name, image, voice, personal story or testimonial in public-facing promotional materials. I will seek appropriate permission before using identifiable content for marketing or publicity.
Please respect the privacy of other participants. Do not share another person's comments, image, contact details or personal story outside a group or session without their permission.
12. Recordings of sessions and events
Some online classes, workshops, group calls or other events may occasionally be recorded. Where a session may be recorded, I will explain this in advance and provide relevant information about the purpose and use of the recording.
A recording may be made available to participants who are entitled to access a replay, where appropriate.
Using a recording for promotional or public-facing purposes is a separate matter and will require an appropriate legal basis and any consent or permission required by law.
You can keep your camera off or avoid speaking during a recorded group session where the format allows this. If you have questions or concerns about recording, please contact me before the session.
One-to-one sessions will not be used for public promotional purposes simply because a session takes place. Any recording or public use involving you will be discussed separately and handled in accordance with applicable data protection and privacy requirements.
Further information about how personal data is handled is available in my Privacy Policy.
13. Privacy and personal information
I handle personal information in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR) and relevant Spanish legislation.
When you contact me, book a service, make a purchase or subscribe to emails, I may need to use your information to respond, administer your booking, provide your purchase, process payments, send service-related communications and meet legal obligations.
Where relevant, my Privacy Policy explains what information is collected, why it is used, the lawful basis for processing, how long it is retained, whether it is shared with service providers, and how you can exercise your rights.
Please read the Privacy Policy available on my website before submitting personal information. Information you share about your health or wellbeing may be particularly sensitive and will be handled in accordance with applicable requirements.
Marketing emails will be sent in accordance with the applicable rules. You can unsubscribe using the link in a marketing email or contact me at [email protected].
14. Third-party platforms and links
My website or services may link to, or use, third-party platforms for website hosting, payments, video delivery, email communications, bookings or other functions.
Those services may have their own terms and privacy policies. I am not responsible for the content, security or policies of external websites or services that I do not control. A link does not necessarily mean that I endorse the linked organisation or its content.
Where I rely on a third-party provider to deliver a service you have purchased, this does not remove any obligations or responsibilities I have to you under applicable law.
15. Website information and availability
I aim to keep the information on this website accurate and up to date. However, occasional errors, omissions or technical interruptions may occur. I may update website content, improve services or make changes to the way the website operates.
If a change materially affects a service you have already purchased, I will address it in accordance with the terms of that offer and applicable law.
Information shared in articles, newsletters, videos and other educational materials is intended for general information and wellbeing education. It should not be treated as individual medical advice or a guarantee of results.
16. Liability
I will provide my services with reasonable care and skill and will meet the obligations imposed on me by applicable law.
To the extent permitted by law, I am not responsible for losses arising from misuse of the website, failure to follow reasonable safety guidance, or circumstances outside my reasonable control. This does not exclude responsibility where I am legally liable, nor does it limit any rights or remedies that consumers have under mandatory law.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
17. Changes to these Terms
I may update these Terms from time to time to reflect changes to my services, website, business practices or legal obligations.
The latest version will be published on this website with its updated date. Changes will apply from the date stated in the updated Terms, subject to any notice requirements or legal protections that apply to an existing purchase or contract.
If a change materially affects an existing service or membership, I will provide any notice required by law.
18. Applicable law and disputes
These Terms are governed by Spanish law, subject to any mandatory consumer protection rules that apply to you.
If you have a concern or complaint, please contact me first at [email protected] so that I have an opportunity to help resolve it.
Nothing in this section prevents you from exercising your legal rights or bringing a claim before a court with jurisdiction under applicable law. Any dispute will be handled by the competent courts as determined by the applicable legal rules.
